Summary: US District Court stops Sanders Design International from selling the 20/20 System

March 10, 2004 (Merrimack, NH) - Solidscape, Inc. announced today that the United States District Court for the District of New Hampshire had granted its request for a preliminary injunction against Sanders Design International (SDI). The Court ordered that “SDI, its agents, affiliates, subsidiaries, and anyone acting by or through them, are hereby enjoined and restrained from marketing or selling the 20/20 System and from engaging in any conduct relating to the marketing or sale of the same pending further order of the court.” The Court made preliminary findings that “SDI is offering for sale 20/20 units which contain Plaintiff's (Solidscape's) intellectual property” and that Solidscape had “sustained its burden and is likely to succeed on the merits” at trial.

Solidscape had previously filed a complaint in the United States District Court for the District of New Hampshire against SDI, Royden Sanders, Jr. and Albin Hastbacka alleging patent infringement, deceptive trade practices, copyright infringement, breach of fiduciary duty, misappropriation of trade secrets, breach of confidential relationship and breach of contract. Solidscape is seeking a permanent injunction against SDI's infringement of its intellectual property as well as compensatory damages, treble damages and attorneys' fees.

There has been a great deal of confusion in the minds of prospects and customers, which has now been cleared up. Solidscape expects to prevail at trial later this year and once and for all put this issue to bed.
